【聲援行動】移工還沒有保障!權益要再等多久?

12月13日,TIWA台灣國際勞工協會以及台灣移工聯盟(MENT)共同召開記者會,要求立法院盡速立法,保障家務工勞動權益,最後以「家事服務法」的A4紙張蓋住充滿破洞的雨傘,希望政府盡速立法填補傘的漏洞、保障家務工權益。

婦女新知基金會長期以來關注移工問題,前往聲援並發言如下:

各位好,我是婦女新知基金會倡議部主任。今天站在這邊聲援移工,希望立法院儘速處理家庭看護工的勞動權益,是因為台灣的家務移工超過99%是女性,她們照顧我們的家人,讓我們能好好工作、就學,對台灣社會的貢獻早已超越國籍。但是她們至今仍然沒有權利對自己的勞動權益發聲。我們的移工政策卻剝奪了她們的基本權利,她們的薪資跟基本工資脫鉤、無法自由轉換雇主、勞動權益與人身安全毫無保障。

每一次的移工遊行婦女新知都會跟大家站在一起,因為我們爭取女人對公共決策表達意見的權利,擁有平等的影響力,我們花了近百年的時間爭取性別平等、爭取婦女參政權益、爭取女性在不同位置的發言權,現在讓我們跟移工站在一起,她們每天和我們一起工作、一起生活、一起笑、一起哭。她們本該對自己的工作、生活,擁有表達意見的權利和平等的影響力,特別是她們的基本權利。

我們看到家務移工被排除在台灣的勞動權益保障制度之外,即使是適用的職業安全衛生法或性別工作平等法,落實的狀況也非常的不好。我們都知道CEDAW國際公約已經在2011年國內法化,且CEDAW第一章即明確指出禁止歧視的原則,我們希望立法院立刻審理民間團體所提出的家事服務法,以立法禁止歧視,並且保障在台移工的權益。

Still No protection! How long do we need to wait?

Hi I'm the director of advocacy from Awakening Foundation. Today we are here to stand with migrant workers and we want Legislative Yuan to have legislation to protect migrant workers legal rights. This is because there are more than 99% of domestic workers are women. They take care of our family, so that we can devote ourselves to our jobs and studies. Migrant workers have contribute a lot to Taiwan society. However, until now, they cannot speak up for their own rights in their working condition. This is because Taiwan government has made the law to deprive their rights. Their monthly pay is lower than the minimum wage in Taiwan. They cannot transfer to other employer freely by themselves. They have no legal protection when they are working in Taiwan.

Every time there is a migrant workers rally, there is Awakening Foundation. This is because we fight for women rights in every aspects: the right to speak up for themselves, the rights to participate in public policy, the rights to be protected at different positions. Everyday the migrant workers work together, live, laugh, cry together with us. They should have their rights to speak for themselves, especially on their basic demand of living.

We can see that right now the domestic migrant workers are excluded from the workers protection legislations and systems. Even though all workers are included in “Occupational Safety and Health Act” and “Act of Gender Equality in Employment”, the actual implementation are terrible. We all know that CEDAW, the Convention on Elimination of all forms of Discrimination against Women is implemented in Taiwan since 2011. The chapter 1 of CEDAW points out there should be no discrimination agains gender and occupation. Legislation yuan should review the legislation draft from TIWA and MENT and provide migrant workers legal protection now!
